Every mediation, like every case, is different. Learning about different cases, people and legal issues is one of the things we really enjoy about practicing law and handling mediations.
But, not every case should be mediated in the same way or at the same juncture. We do not believe that the first contact you get from your mediator should be to ask you to set an immediate mediation date. The incorrect approach or timing often leads to failed mediations that make for greater costs, more time and additional mediations (often with a second, third or fourth mediator!).
As experienced litigators, we know that some cases must be mediated early on, while others should be mediated much later in order to have a good shot at success. Some cases require that the mediator simply work as sounding board for issues and others require the mediator to provide a third-party analysis and a strong voice.
Our goal is to learn about your case - the facts, the issues, the law, the venue, the procedure, the parties, and the lawyers - so that we can handle your mediation in the time and manner that is most likely to get it resolved efficiently and effectively.
